This document (the “Privacy Policy”) explains how we use the information collected from products you purchase across your digital, cloud, and web-based systems (the "Site”), such as POS systems connected to our MFMsoft software (referred to as “MFM”).
MFM is an operating system software that serves as a tool interface between you and your systems. By enrolling in MFM, you grant MFM the authority to act as your tool to work on your behalf and to seamlessly monitor and manage the products you sell. Each of your systems must be enrolled individually and have a separate MFM license issued.
MFM is not a third-party service that accesses platforms on your behalf. Instead, when enrolled, it is a tool you license to access your systems and accounts, helping you use automation for more efficient product management, including but not limited to sales communication, updating product availability, and more.
This Privacy Policy explains the data collected by your MFM tool when customers make purchases of your products, how that data is used and shared, and your rights and options regarding your product data. It details how your product purchasing data is gathered, utilized, and shared through the MFM software when a customer makes a purchase from your systems. PERSONAL DATA - WE DO NOT COLLECT.
“Personal data” is any information that can identify, relate to, describe, be associated with, or be reasonably capable of being associated with a particular individual consumer, such as their name, address, and banking information. Personal data does not include anonymous, de-identified, or non-personal data.
Neither MFMsoft, the Company, nor your MFM tool has access to or collects any Personal Data. Neither MFMsoft, the Company, nor MFM collects or stores personal data from you or your customers. The MFM tool only captures transactional data related to products sold, which helps you and your business analyze sales performance, improve procurement, increase sales opportunities, manage inventory, and enhance your business in other ways. The data captured includes product details (name, category, and UPC Number), transaction information (quantity, sale price, date of sale, and time of sale), and similar data. MFMsoft, the Company, nor MFM captures consumer personal information such as consumer name, email, phone, address, banking info, etc.
BRANDING INFORMATION USED BY YOUR DIGITAL SYSTEMS AND MFM.
If you have enrolled digital systems, such as online menu platforms, to your MFM license, your MFM tool will update each of the Brand Product assets licensed with MFMsoft, such as your trademarked images, copyrighted names, and descriptions. Your tool will replace your manual work with automation, making you more efficient, eliminating human error, and ensuring that all your product presence and images are consistent. Each Brand partner of the company authorizes you to use their product trademarked images, descriptions, and product information on any of your Digital Systems. MFM seamlessly keeps your online menus updated with all current Brand product images or information and immediately updates your Digital Systems without any interruptions to your current environment. Also, the MFM tool will capture your sales and transactional data as it flows into your POS system. The consumer sales data captured will be product-related, such as time of purchase, quantity, product details, and more. PRODUCT PURCHASING DATA COLLECTED.
When your customers buy products from your digital systems, your MFM tool automatically collects transaction information directly related to the products purchased. MFMsoft, the company, and MFM will only use product purchasing data for the purposes it was collected for or as permitted by applicable laws and regulations. As noted, MFMsoft, the company, and your MFM tool do not gather Personal Identifiable Information (PII) from your customers, including indirect PII such as IP addresses and device identifiers. The MFM tool only collects product-related data from digital systems, such as what products are sold, when they are sold, and details of the sold products. Additionally, when your customers make or attempt to make a purchase, your MFM tool does not access or gather any of their information, including their name, billing address, shipping address, or payment details (credit card numbers, email, and phone number). We refer to this information as “Order Information”.
USE OF PRODUCT PURCHASING DATA AND YOUR CONSENT.
The Company's primary purpose in collecting your product purchasing data is to enable and support seamless, automated, and AI-driven services, acting as tools so you don’t have to do it manually. You give the Company full consent to use the data by opting in and licensing MFM as a tool. When required by law, the Company obtains your consent to use and process your product purchasing data for business purposes. Otherwise, we rely on other authorized legal bases (including, but not limited to, performing a contract or legitimate interest) to collect and process your data. We use your product purchasing data to measure product performance. Our goal is to collect this data to assess the sales performance of products sold through your Digital Systems to consumers. We utilize this information to generate performance reports and analyze trends related to the types of products purchased, the timing of purchases, and the quantities bought, all to help you maximize product sales across your sites.
This product purchasing data will be retained for as long as necessary to fulfill the purposes for which it was collected or as required by applicable laws and regulations. When product purchasing data is no longer needed, it will be securely disposed of or genericized, unless otherwise required by law.
