Privacy Policy

MFMsoft, LLC (referred to as “Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your privacy online. The purpose of this document (the “Privacy Policy”) is to explain to the Merchant (referred to as “You”) how we use information that we have collected from the products that are purchased from you across your digital, cloud, and web-based systems (the "Site”), such as online menu and POS systems that you have connected to our MFMsoft AI-Driven management software called Mobi. Mobi is the MFMsoft operating system software that acts as an interface between you and your cloud systems for the Company products that you are selling.

This Privacy Policy describes the product data we collect, how the product data is used and disclosed, and your rights and choices regarding your product data. This Privacy Policy describes how your product purchasing data is collected, used, and shared using MFM’s digital menu management software Mobi, when a customer visits any digital systems to transact with you. PERSONAL DATA WE DO NOT COLLECT. 
“Personal data” is defined as any information that can identify, relate to, describe, be associated with, or reasonably be capable of being associated with a particular customer or individual consumer who has purchased from you. Personal data does not include anonymous, de-identified, or non-personal data.

MFM does NOT have access to or collect any Personal Data.


DIGITAL SYSTEM DATA WE COLLECT. 
Using our AI-Driven automation, the Mobi system captures and collects all Company Product sales you sell through your Digital Systems to your customers. Mobi also captures all other product sales data sold with the Company Products and other products sold. The Mobi AI is activated when you select from the Company Mobi Digital System Link Form your Digital Systems and input each Systems login and password. MFMsoft has integrated the Digital Systems to the Company Mobi Digital System Link Form, so entering your login and password is done directly on that Digital System. This is done through a secured source. By doing so, you initiate MFMsoft to collect all data points on products, time of sale, and location. Also, the Company authorizes you to use their product trademark, images, descriptions, nutritional facts, and product information on any of your Digital Systems. This enables the Company to change its product images or information and immediately update your Digital Systems without any interruptions to your current environment. Also, the Company will have access to capture product purchase data from your Digital Systems.


PRODUCT PURCHASING DATA WE COLLECT. 
When your customers purchase company products from your digital systems, we automatically collect certain transactional information related to the customers' transactional information. We do NOT collect Personal Identifiable Information (PII) from your customers. MFM only collects product-related data from Digital Systems, such as the products sold, when the product is sold, details of products sold, etc. This data collection intends to help the Company optimize and understand how their products are sold, what products are sold, how to improve customer support, create better data-driven marketing campaigns, improve manufacturing and delivery efficiencies, and support your on-premise and off-premise digital and online sales. Additionally, when your customers make a purchase or attempt to make a purchase, we do NOT have access to collect any information about them, including their name, billing address, shipping address, payment information (credit card numbers, email address, and phone number). We refer to this information as “Order Information”.


USE OF PRODUCT PURCHASING DATA. 
Our primary purpose in collecting product purchasing data is to facilitate and provide the services or information that you have selected to receive. Where the law requires, we obtain your consent to use and process our product purchasing data for these purposes. Otherwise, we rely on another authorized legal basis (including but not limited to the performance of a contract or legitimate interest) to collect and process product purchasing data. We use product purchasing data to Measure Product Performance. We intend to collect product purchasing data to measure the sales performance of the Company Products across your Digital Systems. We use this information to create performance reports and to analyze trends on the type of Company products purchased, with what products they were purchased, when they were purchased, and the quantities purchased to ensure that you’re maximizing the Company Product sales across your Digital Systems.


SHARING OF PRODUCT PURCHASING DATA. 

  1. Affiliates and Service Providers. We share product purchasing data with our affiliates, Companies, and data partners. Like most businesses, we share product purchasing data with third-party service providers or vendors under contractual agreements.
  2. Advertisers. We may share product purchasing data with our advertising partners. Our advertisers may use the product purchasing data information to display advertisements to their customer base or for other reasons.
  3. Business Transfers. We may transfer product purchasing data to a third party as a part of a potential sale, merger, reorganization, or other similar transaction. In accordance with applicable laws, we will use reasonable efforts to notify you of any transfer of personal data to an unaffiliated third party.
  4. Consent. We may disclose your product purchasing data to certain third parties with your consent.


ADDITIONAL TERMS. 

  1. Behavioral Data Usage. As described above, we use the product data collected to provide advancements to the ordering process, enhance the interaction and transaction experience, help analyze buying behavior to improve user experience, track purchasing tendencies to eventually use AI to maximize purchase opportunity and maximize your customer’s purchasing experience and much more. Please note that we do not alter our data collection.
  2. Age of Use of Our Software. Our services are not directed to individuals under 18, and we do not knowingly collect personal data from them.
  3. Privacy Policy Updates. We reserve the right, at any time, to modify this Privacy Policy. You should review this Privacy Policy periodically to keep updated on our current policies and practices. We will note the effective date of the latest version of our Privacy Policy at the end of this Privacy Policy.
  4. At MFMSoft, we prioritize the security of our customers' data and are committed to ensuring information confidentiality, integrity, and availability. We employ robust security measures to safeguard against unauthorized access, disclosure, alteration, or destruction of customer data. Our security measures include:
    1. Encryption Protocols: We utilize industry-standard encryption protocols to protect data transmission and storage, ensuring that sensitive information remains secure.
    2. Access Controls: Access to customer data is strictly controlled and restricted to authorized personnel only. Role-based access controls are implemented to limit privileges and minimize the risk of unauthorized access.
    3. Authentication Mechanisms: Multi-factor authentication is enforced to verify the identity of users accessing our systems, adding an extra layer of security beyond traditional password protection.
    4. Monitoring Procedures: We continuously monitor our systems for suspicious activities, unauthorized access attempts, and potential security threats. Real-time alerts and automated monitoring tools help us proactively detect and respond to security incidents.
    Additionally, MFMSoft adheres to industry best practices and complies with recognized security standards, such as ISO 27001 or SOC 2, to demonstrate our commitment to data security and compliance.
  5. Data Breach Response Plan. In the unlikely event of a data breach, MFMSoft has implemented a comprehensive data breach response plan to mitigate risks and minimize impact. Our response plan is designed to ensure swift and effective action to protect customer data and maintain trust and transparency with our users. Our data breach response plan includes the following key steps:
    1. Investigation Procedures: Upon discovery of a potential breach, our incident response team conducts a thorough investigation to assess the scope and severity of the incident. This may involve forensic analysis, log reviews, and collaboration with external security experts.
    2. Mitigation Efforts: We take immediate action to contain and remediate the breach, including isolating affected systems, patching vulnerabilities, and implementing additional security controls to prevent further exploitation.
    3. Customer Notification Processes: We prioritize timely and transparent communication with affected customers, providing clear and concise notifications detailing the nature of the breach, the potential impact on their data, and recommended steps for protection.
    4. Cooperation with Regulatory Authorities: MFMSoft cooperates fully with regulatory authorities and relevant stakeholders, complying with legal requirements for reporting data breaches and providing necessary investigation assistance.
    We are committed to keeping our customers informed throughout the breach response process, ensuring transparency and accountability in our actions.
  6. Customer Data Handling. At MFMSoft, we take the responsibility of handling customer data seriously and are committed to protecting the privacy and security of personal information entrusted to us. Our data handling practices are designed to ensure transparency, accountability, and compliance with applicable data protection laws and regulations. We collect, process, store, and use customer data for the following purposes:
    1. Providing SaaS Services: Customer data is collected and processed to deliver our software-as-a-service (SaaS) solutions, enabling users to access and utilize our Mobi platform's functionalities effectively.
    2. Improving Product Offerings: We analyze customer data to identify usage patterns, trends, and feedback, allowing us to enhance our Mobi products, optimize user experience, and address customer needs effectively.
    3. Compliance with Legal Requirements: We may process customer data to comply with legal obligations, such as regulatory requirements or court orders, ensuring adherence to applicable laws and regulations.
    We do NOT collect customer data that may include personally identifiable information (PII) or sensitive data, such as names, contact details, payment information, or user preferences. We handle all Company Product Data carefully and implement appropriate technical and organizational measures to protect against unauthorized access, disclosure, or misuse.
  7. Third-Party Service Providers. MFMSoft may engage third-party service providers or subprocessors to assist in processing customer data and delivering our services effectively. These third parties may have access to customer data only to the extent necessary to perform their designated functions and are contractually obligated to maintain the confidentiality and security of the data. We disclose the involvement of third-party service providers and outline the purposes for which they are engaged, including:
    1. Hosting and Infrastructure Services: Third-party providers may help host our systems, databases, and infrastructure components, ensuring reliable performance and scalability.
    2. Data Analytics and Insights: We may collaborate with third-party analytics providers to analyze customer data and derive valuable insights to improve our Mobi products and services.
    3. Customer Support and Maintenance: Third-party vendors may provide customer support services or technical assistance to ensure our Mobi platform's smooth operation and maintenance.
    MFMSoft conducts due diligence and enters into contractual agreements with third-party service providers to ensure compliance with relevant data protection laws and regulations. We monitor their performance and adherence to security standards to safeguard customer data and maintain trust and confidence in our Mobi services.
