Privacy Policy

MFMsoft, LLC (referred to as “Company,” “we,” “us” or “our”) respects your privacy and is committed to protecting your privacy online. The purpose of this document (the “Privacy Policy”) is to explain to you how we use information that we have collected from the products that are purchased from you across your digital, cloud, and web-based systems (the "Site”), such as online menu and POS systems that you have connected to our MFMsoft digital menu management software called Mobi. Mobi is the MFMsoft operating system software that acts as an interface between you and your cloud systems for the Company products that you are selling.

This Privacy Policy describes the product data we collect, how the product data is used and disclosed, and your rights and choices regarding your product data. This Privacy Policy describes how your product purchasing data is collected, used, and shared by using MFM’s digital menu management software called Mobi when a customer visit any of your digital systems to transact with you. “Personal data” is defined as any information that can identify, relate to, describe, be associated with, or be reasonably capable of being associated with a particular individual consumer. Personal data does not include anonymous, de-identified, or non-personal data. MFM does NOT have access or collect any Personal Data.

When you use Mobi to select the Company products you are selling you will need to also select the Digital Systems you are using to sell those Company products through. As you do so, you will need to input each Digital Systems login and password of your Digital Systems through a secured source so that on behalf of you, those Company products can be injected into your Digital Systems and menus. By doing so, the Company is authorizing you to use their Company product trademark, images, descriptions, nutritional facts, and product information on any of your Digital Systems. This enables the Company to be able to change their product images or information and immediately update your Digital Systems without any interruptions to your current environment. Also, Company will have access to capture now their specific product purchase data.

When your customers purchase Company products from your Digital Systems, we automatically collect certain transaction information that has to do with the customer’s transactional information that is directly associated to Company products. We do not collect any Personally Identifiable Information (PII) from your customers. MFM only collects Company product-related data from Digital Systems such as the products sold, when the product is sold, details of Company products sold, etc. The intent of this data collection is to help optimize and support your on-premise and off-premise digital and online sales. Additionally, when your customers make a purchase or attempt to make a purchase, we do not have access to or collect any information about them, including their name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number). We refer to this information as “Order Information”. Also, we do not collect to use any product data that is not directly associated with the Company and the Company products.

Our primary purpose in collecting our Company product purchasing data is to facilitate and provide the services or information that you have selected to receive. Where required by law, we obtain your consent to use and process our Company product purchasing data for these purposes. Otherwise, we rely on another authorized legal basis (including but not limited to the performance of a contract or legitimate interest) to collect and process our Company product purchasing data. We use Company product purchasing data to Measure Product Performance. Our intention of Company collecting product purchasing data is to be able to measure the sales performance of the Company’s products that are injected across your Digital Systems. We use this information to create performance reports and to analyze trends on the type of Company products purchased, when they were purchased, and the quantities purchased to ensure that you’re maximizing the Company’s products sales across your Sites.


  1. Affiliates and Service Providers. We share Company product purchasing data with our affiliates, Companies, data partners, and like most businesses, we also share Company product purchasing data with third-party service providers or vendors that are under contractual agreements with us. Data obtained through the short code program will not be shared with any third-parties for their marketing reasons/purposes.
  2. Advertisers. We may share Company product purchasing data with our advertising partners. Our advertisers may use the Company product purchasing data information to display advertisements to their customer base or for other reasons.
  3. Business Transfers. We may transfer Company product purchasing data to a third party as a part of a potential sale, merger, reorganization, or other similar transaction. In accordance with applicable laws, we will use reasonable efforts to notify you of any transfer of personal data to an unaffiliated third party.
  4. Consent. With your consent, we may disclose your product purchasing data to certain third parties.
Data obtained through the short code program will not be shared with any third-parties for their marketing reasons/purposes.


  1. This program may send two-factor authentication (2FA) messages to verify users signing into their account profile, as well as account notifications and marketing/promotional messages to users who register through our B2B website.
  2. You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.


  1. Behavioral Data Usage. As described above, we use the Company product data collected to provide advancements to the ordering process, enhancing the interaction and transaction experience, help analyze buying behavior to enhance usage experience, track purchasing tendencies to eventually use AI to maximize purchase opportunity and maximize your customers purchasing experience and much more. Please note that we do not alter our data collection.
  2. Age of Use of Our Software. Our services are not directed to individuals under the age of 18, and we do not knowingly collect personal data from individuals under the age of 18.
  3. Privacy Policy Updates. We reserve the right, at any time, to modify this Privacy Policy. You should review this Privacy Policy periodically so that you keep up to date on our most current policies and practices. We will note the effective date of the latest version of our Privacy Policy at the end of this Privacy Policy.
